Contracts awarded by the Ohio School
Facilities Commission (or approved by the Commission
for OSFC-funded projects) are awarded through one of
two types of competitive selection processes. The selection
process is either through a) competitive bidding or through
b) a qualifications based process pursuant to state law.
The competitive bidding process used for awarding
trade contracts follows the law established
for boards of education, which mandates the
selection of the lowest responsible bidder.
The actual contract is awarded by the local
board of education, following a thorough review
that establishes that the firm is capable of
fulfilling the terms of the contract. Firms
interested in bidding on trade contracts should
routinely monitor the statewide bidding calendar.
The qualifications-based selection process used by OSFC
to select construction management firms and other consultants
follows the Ohio Revised Code and expands the process
to include development of a “short-list” of
qualified firms based on staff evaluations of proposals;
structured interviews for short-listed firms, and a final
selection based on the ranking of firms from those interviews.
OSFC strives to make the qualifications-based process
as transparent and as fair as possible, through such
actions as
a. Providing for the written submission of questions
regarding the services needed.
b. Providing a structured outline of what firms should
cover in the interview, and
c. Developing interview teams consisting of staff members
representing a wide variety of the agency’s operations.

Qualifications |
The
Ohio School Facilities Commission allows school districts participating in OSFC programs
to establish additional qualification criteria or standards
to evaluate bidder responsibility.
The resolution included model
responsible bidder requirements that
may be added to construction contract documents
if a local Board of Education elects to incorporate

Regarding Material Assistance / Non-assistance to a Terrorist
Organization |
| As a result of Ohio Senate Bill 9 (effective
April 14, 2006) applicants seeking certain state issued
business contracts and funding must fill out new forms
indicating that they have not provided financial assistance
or support to a terrorist organization. Information regarding
the Declaration Regarding Material Assistance, including
the Terrorist Exclusion List, can be found on the Ohio
Homeland Security Web site at www.homelandsecurity.ohio.gov/dma.asp.

As required by statute,
OSFC has established a 5 percent EDGE
program participation goal for trades contracts, architect
and engineering agreements, and other professional services.
Proposers for professional services
agreements as well as bidders on construction contracts must
demonstrate actual participation in the EDGE program, or
provide a demonstration of their good faith efforts (with
supporting evidence) to participate in the EDGE program,
or both.
